These Terms of Use ("Terms") govern access to and use of the websites, software, and services provided by Thri5 Inc. ("Thri5," "we," "us," or "our"), including our corporate website and the Thri5 product (collectively, the "Services").
By accessing or using the Services, you agree to these Terms.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
1. Scope of Services
The Services include:
- Thri5's corporate website and related informational content
- Thri5's software platform and related functionality
Certain features or services may be subject to additional terms, order forms, or agreements.
2. Accounts and Access
To access certain Services, you may be required to create an account.
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activity occurring under your account
- Ensuring your users comply with these Terms
You must notify Thri5 promptly of any unauthorized access or security incident.
3. Acceptable Use
You agree not to:
- Use the Services in violation of applicable law
- Interfere with or disrupt the Services
- Attempt to gain unauthorized access to systems or data
- Reverse engineer or copy the Services
- Use the Services to transmit malicious code
Thri5 may suspend or terminate access for violations of this section.

Thri5 retains all right, title, and interest in the Services, including all software, content, and underlying technology.
4.2 Your Data
You retain ownership of any data you submit to the Services ("Customer Data").
Thri5 may process Customer Data solely to provide and operate the Services and as described in the Privacy Statement.
5. Privacy
Thri5's collection and use of personal data is described in our Privacy Statement and Cookie Notice, which are incorporated by reference.
6. Availability and Changes
The Services are provided on an "as available" basis.
Thri5 may modify, suspend, or discontinue the Services at any time.
7. Disclaimers
The Services are provided "as is" and "as available."
To the maximum extent permitted by law, Thri5 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law:
- Thri5 shall not be liable for indirect, incidental, consequential, or special damages
- Thri5's total liability arising out of or relating to the Services shall not exceed CAD $1,000
9. Termination
Thri5 may suspend or terminate access to the Services at any time for violation of these Terms or applicable law.
Upon termination, your right to access the Services will cease.
10. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
